ACCEPTANCE OF TERMS
All quotations, order confirmations, and invoices issued by American Computer Optics, Inc. ("ACO") are subject to these Terms of Sale and to the Product Standards & Notices listed below. Any order placed with ACO by purchase order or by payment acknowledges receipt of these terms and constitutes acceptance of them; no signature is required. Accepting delivery likewise constitutes acceptance. Terms in a customer purchase order or other customer document that conflict with or add to these terms do not apply unless ACO agrees to them in writing.

QUOTATIONS AND ORDERS
Quotations are based on the specifications, make-up, dimensions, and quantities provided by the customer. All products are made to order. Orders cannot be cancelled or changed once fabrication has begun, and made-to-order product is not returnable.

SPECIFICATIONS AND SUITABILITY
The customer is solely responsible for dimensions, make-up, shop drawings, structural and load calculations, installation, and determining that the product is suitable for its intended application. ACO manufactures to the ACO order confirmation and the tolerances in the Product Standards & Notices.

PAYMENT
Payment is due according to the terms stated on the ACO quotation or invoice.

SHIPPING AND RISK OF LOSS
Ship dates are estimates. Title and risk of loss pass to the customer when product is delivered to the carrier. ACO is not responsible for carrier delays. Any visible freight damage must be noted on the carrier's delivery receipt at the time of delivery.

INSPECTION AND CLAIMS
All glass must be inspected within two (2) consecutive days of delivery and before installation. Claims must be made in writing to info@acoinc.net within that period. Installation of any lite constitutes acceptance of that lite. Product within the applicable tolerances is conforming and is not grounds for rejection.

TOLERANCES AND QUALITY
Products are evaluated under the applicable ASTM standards and ACO notices listed below. Additional fabrication, including tempering, heat-strengthening, laminating, and insulating, changes the governing tolerances. Where more than one document or standard could apply, the widest tolerance governs.

LIMITATION OF LIABILITY
ACO'S SOLE OBLIGATION FOR ANY NONCONFORMING PRODUCT IS, AT ACO'S OPTION, REPAIR, REPLACEMENT, OR REFUND OF THE PRICE PAID FOR THAT PRODUCT. ACO IS NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING INSTALLATION OR REMOVAL COSTS, LABOR, DELAYS, OR LOST PROFITS. EXCEPT AS STATED IN THE PRODUCT STANDARDS & NOTICES, ACO MAKES NO OTHER WARRANTY, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

GOVERNING LAW
These terms are governed by the laws of the State of California. Any dispute will be resolved in the courts of Orange County, California.
